Welcome to Area Vista. By accessing or using https://areavista.com (the "Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Website.

We may update these Terms at any time. Changes become effective upon posting. Your continued use of the Website after any changes constitutes acceptance of the updated Terms.

Area Vista is a real estate listing portal for the Dominican Republic. We provide a promotional platform where property seekers can discover listings and where advertisers (property owners, agencies, developers) can promote their properties.

Area Vista is not a real estate agency. We do not participate in negotiations, transactions, or agreements between users. We do not take commissions on any sale, rental, or booking. We do not verify the accuracy of property listings or the identity of advertisers beyond basic account requirements.

You must be at least 18 years of age to create an account, purchase services, or enter into agreements on this Website. By using the Website, you confirm that you meet this requirement.

4.1 Registration

To access certain features (saving favorites, listing properties, submitting booking requests), you must create an account with accurate and complete information.

4.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

4.3 Account Types

Users may have a Seeker profile (browsing, favorites, bookings), an Advertiser account (listing properties, managing subscriptions), or both. Team accounts allow a master account holder to invite agents who can manage listings under the same organization.

You agree to use the Website for lawful purposes only. You agree not to:

• Submit false, misleading, or fraudulent listing content
• Misrepresent your identity or authority to list a property
• Use the platform to facilitate illegal activities
• Interfere with the operation of the Website or its infrastructure
• Attempt to gain unauthorized access to any part of the platform
• Scrape, copy, or redistribute content from the Website without permission
• Use automated tools to access the platform except as authorized

We reserve the right to remove content or suspend accounts that violate these Terms without prior notice.

6.1 Advertiser Responsibility

Advertisers are solely responsible for the accuracy, completeness, and legality of their listing content, including property descriptions, photos, pricing, and availability. Area Vista does not verify listing information.

6.2 Content Standards

Listings must represent real, available properties. Content must not infringe on the intellectual property rights of others. Photos must accurately represent the property.

6.3 Listing Duration

Listings are published for the duration specified by the selected package or subscription plan. Upon expiration, listings are removed from public search results. Expired listings may be renewed or upgraded.

6.4 Removal

We reserve the right to remove or suspend any listing that violates these Terms, contains inaccurate information, or has been reported by other users, at our sole discretion.

Area Vista offers a booking request feature for Short-Term Rental (STR) listings. This feature connects guests with hosts. It is important to understand:

• Area Vista does not process payments for bookings. Payment arrangements are made directly between guest and host.
• Area Vista does not guarantee the accuracy of STR listings, availability, or property conditions.
• Area Vista is not a party to any rental agreement between guest and host.
• Guests and hosts are responsible for their own arrangements, including payment terms, cancellation policies, check-in procedures, and dispute resolution.

Area Vista’s role is limited to providing the platform where the initial connection is made.

8.1 Pricing

All prices are displayed in US Dollars (USD). Current pricing is available on our Packages page at /packages/.

8.2 Payment Processing

Payments are processed through PayPal. By purchasing a service, you agree to PayPal’s User Agreement and Privacy Policy.

8.3 Subscriptions

Pro and STR Pro plans are billed monthly on a recurring basis via PayPal Subscriptions. Subscriptions renew automatically unless cancelled before the renewal date.

8.4 Free Trials

Some plans may include a free trial period. At the end of the trial, your subscription will convert to a paid plan unless cancelled.

8.5 Refunds and Cancellations

9.1 Platform Content

All design, graphics, text, software, and other materials on the Website (excluding user-submitted content) are the intellectual property of Area Vista and are protected by applicable copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works without our written permission.

9.2 User Content

By submitting content to the platform (listings, reviews, messages), you grant Area Vista a non-exclusive, royalty-free, worldwide license to display, distribute, and promote that content within the platform and in marketing materials related to the platform. You retain ownership of your content and may remove it at any time by deleting your listing or account.

The Website and all services are provided on an "as-is" and "as-available" basis. Area Vista makes no warranties, express or implied, regarding the reliability, accuracy, or availability of the platform. We do not warrant that the Website will be uninterrupted, secure, or error-free.

Area Vista does not guarantee the quality, legality, or accuracy of any property listing, user, or transaction conducted through or facilitated by the platform.

To the fullest extent permitted by applicable law, Area Vista shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to damages related to property transactions, rental agreements, or interactions between users.

You agree to indemnify and hold Area Vista harmless from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from your use of the Website, your violation of these Terms, or your infringement of any third-party rights.

We reserve the right to suspend or terminate your access to the Website at our sole discretion, without notice, for any reason, including violation of these Terms. Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will remain in effect.

These Terms shall be governed by and construed in accordance with the laws of the Dominican Republic. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Santo Domingo, Dominican Republic.
